While the 2022 Supreme Court of the United States decision in Dobbs v Jackson Women’s Health Organization may bring the contingent rights of pregnant people to refuse interventions into sharper focus, such rights have long been recognized as precarious and entangled with maternal and fetal health and life considerations (Lyerly et al. C2007). Though Minkoff and colleagues (2024) showcase how a 2021 Texas state law diminished pregnant patients’ rights in favor protecting fetal life, they underestimate how much the federal right to abortion had eroded following the 1992 Planned Parenthood v Casey decision that empowered states to use an undue burden standard for regulating abortion.
